These Terms and Conditions govern your use of our website (www.imaginethiskc.com) and apply to all products and services provided by our Company. By accessing this website, you agree to be bound by these Terms and Conditions in their entirety. If you do not accept all of the terms and conditions stated herein, please do not continue to use our website.

For the purposes of these Terms and Conditions, the following terminology applies:

• "Client," "You," "Your" refers to you, the person accessing this website and accepting these Terms and Conditions.

• "Party" or "Parties" refers to both the Client and the Company, or either one individually.

All terms relating to the offer, acceptance, and consideration of payment necessary to engage our services, whether by formal meetings or otherwise, shall be construed in accordance with the prevailing law of 620 N. Lindenwood Dr., Olathe, KS 66062. Any usage of the above terminology in the singular, plural, capitalization, or gendered pronouns is interchangeable and shall be deemed to refer to the same.

• All sales are final, non-refundable, and non-transferable. This applies to all products and services, including event space rentals, custom décor services, digital products, print-on-demand items, eGift Cards, and custom orders.

• To the maximum extent permitted by applicable law, we exclude all representations, warranties, and conditions relating to our website and its use (including, without limitation, any warranties implied by law regarding satisfactory quality, fitness for purpose, or the use of reasonable care and skill).

• Nothing in this disclaimer will:

  • Limit or exclude our or your liability for death or personal injury resulting from negligence;

  • Limit or exclude our or your liability for fraud or fraudulent misrepresentation;

  • Limit any of our or your liabilities in any manner not permitted by applicable law; or

  • Exclude any of our or your liabilities that cannot be excluded under applicable law.

• The limitations and exclusions set out in this section govern all liabilities arising under these Terms and Conditions, including in contract, tort (including negligence), and for breach of statutory duty.

• To the extent our website and its services are provided free of charge, we shall not be liable for any loss or damage of any nature.

5. Payments & Pricing

• All prices are listed in [USD or applicable currency] and may be subject to applicable taxes.

• We accept payments via [credit/debit card, PayPal, etc.].

• Orders will not be processed until full payment is received.

6. eGift Cards

• eGift Cards issued by Imagine This KC expire 12 months from the date of issue and cannot be extended.

• eGift Cards are non-refundable, non-transferable, and cannot be redeemed for cash.

• Lost or stolen eGift Cards will not be replaced; please treat your eGift Card as you would cash.

 

7. Event Space Rental

• All event space rentals require a signed Service Agreement (provided via our CRM system) and the submission of either full payment or a deposit before confirmation.

• Deposits: The refundability of any deposit is governed by the specific terms set forth in the Service Agreement. In general, if all conditions stipulated in the Service Agreement are met, the deposit may be refundable or applied toward the final payment. However, if the Client cancels the event or fails to meet their contractual obligations, the deposit may be forfeited.

• Clients must adhere to the venue’s policies, including those regarding setup, décor, cleanup, and liability.

 

8. Custom Treats, Favors & Printed Products

• All custom orders (including custom treats, favors, and printed products) are made-to-order and final sale.

• Orders must be placed within the required lead time, and no changes can be made once production has commenced.

• Due to the custom nature of these products, variations in color, texture, or design may occur.

 

9. Backdrops & Décor Rentals

• Rental items (including backdrops and décor) must be returned in their original condition. Any damages or missing items will incur additional charges.

• Rental fees are non-refundable and non-transferable, even if the item is not used.

• Clients must coordinate pickup and return times as agreed upon at the time of booking.

 

10. Digital Products & Print-on-Demand Items

• All digital and print-on-demand products are considered final sale and are not eligible for return, exchange, or refund.

• Digital products are delivered via email or a download link immediately after purchase. Customers must provide a valid email address.

• Print-on-demand items are fulfilled through third-party vendors and may have separate processing times.

 

11. Shipping & Fulfillment

• Processing times vary by product. Estimated delivery times provided at checkout are subject to change.

• Imagine This KC is not responsible for shipping delays, lost packages, or errors due to incorrect addresses provided by the customer.

 

12. Refunds & Cancellations

• All payments are non-refundable and non-transferable, including those for event space rentals, custom décor services, eGift Cards, custom treats/favors, digital products, and print-on-demand items.

• If you experience an issue with your order, please contact us at info@imaginethiskc.com within 48 hours of purchase.

• Due to the nature of our offerings (custom, made-to-order, or digital), cancellations or returns cannot be accommodated.

 

13. Fraud & Abuse

• Imagine This KC reserves the right to cancel or refuse any order, booking, or eGift Card if fraud, unauthorized use, or any violation of these Terms and Conditions is suspected.

• In instances where an order or payment is flagged as fraudulent, we may cancel the transaction, suspend the associated account, and deny future purchases.

• Any misuse or alteration of our digital products, print-on-demand items, event space rentals, décor rentals, or other services may result in cancellation, account suspension, legal action, and financial liability for damages.

• Chargebacks, unauthorized disputes, or attempts to circumvent our non-refundable policy will be subject to thorough investigation.

 

14. Changes & Updates

Imagine This KC reserves the right to update or modify these Terms and Conditions at any time without prior notice. Your continued use of our website after any such changes constitutes acceptance of the updated Terms and Conditions.

16. Indemnification

• Your violation of these Terms and Conditions, or

• Your infringement of any intellectual property or other rights of any person or entity.

17. Governing Law, Venue, and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Kansas, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or related to these Terms and Conditions or your use of the website shall be instituted exclusively in the state or federal courts located in Johnson County, Kansas. You hereby consent to the personal jurisdiction and venue of such courts for the resolution of any disputes.

• Severability: If any provision of these Terms and Conditions is found by a court of competent jurisdiction to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

• Waiver: The failure of Imagine This KC to enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.

Imagine This KC shall not be liable for any delay or failure in performance due to causes beyond its reasonable control, including, but not limited to, acts of God, war, terrorism, labor disputes, governmental regulations, or any other events or circumstances beyond our control.

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and Imagine This KC regarding your use of our website and our services. They supersede all prior and contemporaneous understandings or agreements, whether written or oral, regarding such subject matter.

This document constitutes the entire agreement between the Client and Imagine This KC with respect to the subject matter hereof and supersedes all prior or contemporaneous understandings or agreements, whether written or oral.
